Gas prices continue to decline in Oklahoma

OKLAHOMA CITY (AP) -- The price of gasoline continues to decline across much of Oklahoma.

AAA Oklahoma said Tuesday in its weekly price survey that one gallon of regular self-serve gas was just under $2.97 per gallon ? down 2 cents per gallon from last week.

The price in selected cities ranged from $2.87 per gallon in both Tulsa and Bartlesville to $3.17 per gallon in Idabel. The average in Oklahoma City was $2.93 per gallon and in Lawton the price was about $2.97 per gallon.

AAA says the average price in Oklahoma is the fifth-lowest in the nation after Utah, Wyoming, Colorado and Idaho while Hawaii has the highest average price at $4.06 per gallon.

The nationwide average is $3.30 per gallon.

German economy shrank in Q4 in face of euro crisis

FRANKFURT, Germany (AP) ? Germany's economy has fallen victim to economic problems hitting the rest of the eurozone and shrank in the fourth quarter of 2012, preliminary government figures show.

According to government figures released Tuesday, the German economy grew by a modest 0.7 percent in 2012 ? well below the 3 percent growth seen in 2011 and suggests the economy contracted in the last three months of the year. The German government said that shrinkage could be around 0.5 percent.

Germany has so far avoided the fate of seven of its fellow members of the group of 17 European Union countries that use the euro and avoided a recession. This has been down to the country's strong export-led economy. However, the economy of the eurozone as a whole as fallen into a recession and demand for German exports from struggling countries such as Spain, Portugal and Greece has dropped as a result. Meanwhile, Germany's industries have cut back on investment.

Analyst Carsten Brzeski at ING bank estimated that the numbers showed the German economy shrank around 0.3-0.4 percent in the last three months of 2012. A 0.4 percent contraction amounts to an annualized drop of roughly 1.6 percent.

Economic growth was 0.8 percent in the first quarter, 0.3 percent in the second and 0.2 percent in the third. Due to a methodological quirk, German state statistics agency releases annual growth figures before it issues official fourth-quarter numbers, which will be announced next month.

Germany's economy had been widely forecast to contract in the final quarter of 2012 but analysts remain optimistic that it will recover and escape recession, defined as two consecutive quarters of negative growth. The country's Bundesbank central bank has said it does not expect that to happen even though growth for all of next year should come in at an anemic 0.4 percent.

Analyst Rainer Sartoris at HSBC said that domestic demand remained a drag on the economy because businesses were not investing in new plants, buildings and equipment even as consumers were willing to spend money. Wages grew 3.6 percent last year, the third strong increase in a row.

The recent easing of financial market turmoil from the eurozone crisis over too much government debt in some countries could help motivate businesses to spend more in investment.

"After growing relatively healthy at the start of 2012, the economy has entered into a weak spot at the end of the year," he said. "We expect the weakness to be relatively short-lived with respect to latest indications of a pick up of global economic activity."

Germany also said it had reached a balanced budget under the official EU debt criteria, turning in a small surplus for 2012 of 0.1 percent of annual economic output.

Standard Kilogram Needs Trimming

60-Second Science

Contaminants have made the standard kilogram weigh slightly more than it originally did, but a careful cleaning method may slim it down. Sophie Bushwick reports.

More 60-Second Science

How do you define one kilogram? Easy: it's the exact mass of a metal cylinder called the International Prototype Kilogram, IPK for short, kept in controlled conditions in France. But the standard kilogram has gained weight since its creation in 1875. To trim it and its many replicas down to size, we need to clean them. The report is in the journal Metrologia. [Peter Cumpson and Naoko Sano, Stability of reference masses V: UV/ozone treatment of gold and platinum surfaces]

When scientists analyzed the surface of an IPK replica, they found it carried tens of additional micrograms. These changes are due to contaminants building up on the kilograms, despite their careful storage under glass. The additional mass is equal to just a few grains of sand. But the kilogram is such an essential unit that tiny changes to different replicas are important.

To remove the contaminants, we need a standard and reproducible cleaning method. Researchers exposed one kilogram measure to ozone and ultraviolet light, which removed the carbon-based contamination without damaging the metal. But to permanently standardize the kilogram, we'll need to define it in terms of fundamental constants, not a lump of metal in a jar.

?Sophie Bushwick

Reid denies involvement in Utah businessman scheme

SALT LAKE CITY (AP) ? Senate Majority Leader Harry Reid's office said Monday he was never involved in a deal to have a Utah businessman pay the senator to make a federal investigation disappear.

St. George businessman Jeremy Johnson, who's accused of running a $350 million software scheme, said a top official in the Utah attorney general's office orchestrated an agreement in 2010 to pay $600,000 to someone connected to Reid.

Johnson told The Salt Lake Tribune over the weekend that he believed Reid would intervene in the Federal Trade Commission's investigation into his business.

A spokeswoman for Reid's office, Kristen Orthman, said Monday that the Nevada Democrat "had no knowledge or involvement" in Johnson's case and said the allegations "are nothing more than innuendo and simply not true."

Federal prosecutors allege that Johnson's company sent software to consumers for a supposedly risk-free trial but billed them anyway.

Johnson was arrested at a Phoenix airport in 2011, carrying more than $26,000 in cash and a one-way plane ticket to Costa Rica.

Prosecutors initially charged him with one count of mail fraud. He was set to enter a guilty plea Friday to two additional charges of bank fraud and money laundering as part of an agreement with the government.

But that deal fell apart after Johnson and prosecutors disagreed over the terms. Johnson instead decided to maintain his not guilty plea and the case is set to go to trial.

On Saturday, the Tribune reported that Johnson provided the newspaper with emails, financial statements, photos and a transcript of a recorded meeting with John Swallow, then the state's chief deputy attorney general.

Only one email from Johnson was available on the newspaper's website.

Swallow was elected as Utah Attorney General in November and was sworn into office last week. He has strongly denied the allegations and maintains he only offered to connect Johnson with a lobbying firm.

After the FTC filed a lawsuit against Johnson and nine business associates in December 2010, Johnson said he asked Swallow to return part of the $250,000 he had paid. Johnson said he doesn't know if anyone connected to Reid received it.

Swallow, a Republican, said he told Johnson he would not interfere with the FTC investigation or advocate for Johnson to the U.S. attorney.

"Any suggestion by Mr. Johnson that I have been involved in illegal or inappropriate activity regarding his FTC case or any other matter is false and defamatory," he said.

Swallow said he connected Johnson to someone who could hire lobbyists but did not participate in any agreement or receive any payment. He said Johnson is trying to divert attention from his own problems.

Utah Democrats have called for an independent investigation to look into the allegations against Swallow.

Swallow's office declined to answer questions Monday and said they would be issuing a statement. Messages left with Reid's office for further comment on Monday weren't immediately returned.

Late Monday afternoon, Swallow's office released a letter asking the U.S. Attorney's Office in Salt Lake City to investigate Johnson's claims.

Swallow said he's confident an investigation will clear his name.

"These lies he's told have been fabricated for some end I cannot imagine. That's what I hope this investigation will show. I'm looking forward to clear my name and show people that this didn't happen," Swallow told The Associated Press Monday evening.

The U.S. Attorney's Office in Salt Lake City has declined comment on whether there is an investigation into the alleged deal.

Before his arrest, Johnson donated generously to charities and to the political campaigns of former Utah Attorney General Mark Shurtleff. He gave $2,400 to Reid's re-election campaign in July 2010, according to Federal Election Commission records.

Johnson also used his personal helicopters to aid search and rescue efforts in southern Utah and made international headlines in January 2010 when he purchased a plane to fly doctors and other critical supplies to Haiti following a devastating earthquake.

Johnson, 37, could face decades in prison if he's convicted. He is currently free on a $2.8 million bond.

Prosecutors on Friday said they plan to file a new indictment in the case within a month, but wouldn't comment on whether other people besides Johnson would be charged.

A spokeswoman for Johnson's attorneys released a statement Monday afternoon saying Swallow's claims that he was uninvolved and had no knowledge of the agreement are false.

"Johnson stands by his comments, as told to the Salt Lake Tribune, and continues to believe that his understanding of the agreement to be accurate," the statement said.

Toyota is world's largest automaker again

6 hrs.

Toyota has again dethroned General Motors as the world's top-selling automaker.?

The Japanese company sold 9.7 million cars and trucks worldwide in 2012, although it's still counting. GM sold 9.29 million.?

Both companies saw higher sales, but Toyota's growth was far larger as it rolled out new versions of popular models like the Camry. GM executives promised sales growth this year, especially in the U.S. Both companies say publicly that they don't care about who wins, but concede that the crown is an important morale booster for employees.?

GM was the top-selling carmaker for more than seven decades before losing the title to Toyota in 2008. But GM retook the sales crown in 2011 when Toyota's factories were slowed by an earthquake and tsunami in Japan. The disaster left Toyota dealers with few cars to sell. The company has since recovered.?

Toyota's comeback from the earthquake, and flooding in Thailand, is only part of the story, says Jeff Schuster, senior vice president of forecasting for LMC Automotive, a Detroit-area industry forecasting firm. The company also has freshened up its stale midsize sedan, the Camry, the top-selling car in the United States.?

GM's global sales rose 2.9 percent last year, it announced Monday at the North American International Auto Show in Detroit. Toyota sales rose 22 percent.?

Schuster expects Toyota to keep the lead over GM this year as it launches a new Corolla.?

"I think that's going to be enough to keep them in their position," he says.?

GM is also contending with a stronger Volkswagen. It narrowly edged out the fast-growing German company for second place in 2012. VW sold a record 9.1 million vehicles.?

Volkswagen, with big sellers like the Passat midsize sedan and Jetta compact, closed in on GM with an 11 percent sales increase across the globe. The United States, where VW Group sales rose 34 percent, led the way.?

Schuster expects GM to hold off Volkswagen in 2013. That's because VW has more of a presence in Europe, where sales are falling as the region struggles with high unemployment and weak economies.?

Mario Cristobal embraces new role at University of Miami

Mario Cristobal was back in green and orange Friday, eager to begin the next phase of his college football life ? despite no longer being a head coach.

?You see the overhaul of the roster and how it?s shaping up to be,? he said.

?With three weeks to go in recruiting, it?s about attack mode. Wherever I need to go, wherever I need to be sent, whatever I need to accomplish, anything involving 2014 or ?15, it?s ?Go!? There?s no time to rest. ? We?re rolling.?

Cristobal, 42, Miami?s new tight ends coach and associate head coach after being fired by FIU, indicated there was no awkwardness at shifting roles with his current staff.

He said other than having ?less gray hair? back in the day, he ?was the same person as a UM [graduate assistant]? as he is now.

?I was the same person as an assistant coach, as a head coach. I don?t think that changes,? he said. ?I think you are what you are when you wake up in the morning and when you go to bed at night. I don?t think it changes. If it does you were probably raised the wrong way.

?I?m ready to accept and excel at each and every role I?m assigned to so that we can do whatever possible to make sure we flat out win at everything we do ? football, classroom, community, everything.?

Actually, he sounded a lot like head coach Al Golden: enthusiastic, aggressive, demanding and professing the development of the whole person, not just the athlete.

?It?s a legitimate regimen and a program that?s built to win championships,? said the former Hurricanes offensive tackle, lauding Golden?s intensity and attention to detail and planning.

?And in every facet, not just football. When development on the human side goes hand-in-hand with what you?re trying to accomplish athletically, that is when you build yourself a locker room full of winners.

?? It?s doing things the right way. A true care factor, which goes extremely far when you?re a teacher. Just knowing what he?s about and what he wants for this program, those things align pretty well. He?s an intense, relentless worker with a vision.?

Golden was at the Hecht Athletic Center during Cristobal?s news conference but did not attend. Earlier in the day, he told WQAM radio host Joe Rose that he and Cristobal were ?kindred spirits.?

?We both took over programs that were just absolutely abysmal and turned them around, so we had a mutual respect from the outside,? Golden said. ?And the day I heard he got let go, I called him, and he picked up at 9 [a.m.]. I was sitting outside a high school in New Jersey. ? I couldn?t believe it. So that was the initial call, and I didn?t know what direction he wanted to go with his career. But when I knew he wanted to be part of [UM] and, obviously, the love that he has for this place and the passion he?s going to bring ? I just think we improved our football program and coaching staff.?

When asked to explain the ?associate head coach? designation, Golden told WQAM that offensive coordinator Jedd Fisch would still oversee the offense and make the calls.

Golden said Cristobal ?is somebody I can count on to help me with ancillary head coaching things and see the big picture a little bit better.

?Clearly his expertise as an O-line coach, a tight ends coach, a guy that has coached many positions and obviously has cultivated talent and recruited in this area, it was just too good a package for us to pass up.?

Cristobal called it ?a tremendous honor to be back.

?Everybody knows how I feel about the University of Miami,? he said. ?When I was a player here it was ingrained, embedded in your mind about being relentless about everything you do. Joining a staff that is committed in the exact same way is an incredible feeling.?

Israel orders Palestinians to quit protest camp

ZAIM, Palestinian Territories ? More than 200 Palestinian activists were on Saturday evening refusing to leave a protest camp they set up in part of the occupied West Bank where Israel wants to build new settler housing units, despite a threat to evict them.

?Members of the Israeli Civil [military] Administration told us this morning that we have one hour to evacuate the site,? one of the organisers, Abir Copty, told AFP.

?We have no intention of leaving of our own accord,? she said, adding that the Israeli authorities had declared the area a ?closed military zone? and told the activists to leave, but had made no demand for the tents to be taken down.

The military set up roadblocks around the hilltop site, AFP journalists at the scene reported.

Palestinian negotiator Saeb Erekat said soldiers prevented him from joining the protest and told him to turn back to the West Bank city of Ramallah, just down the hill from the camp.

The Palestinians erected the 20-tent ?outpost? on Friday in the sensitive E1 West Bank corridor east of occupied Jerusalem where Palestinians say Israeli settlement construction would destroy the prospects of territorial contiguity for their promised state.

They modelled their action on the wildcat outposts set up by Jewish settlers on Palestinian land in a bid to force the government?s hand into authorising settlement activity.

Israeli authorities quickly issued eviction expulsion orders against the activists, but late on Friday their lawyers successfully petitioned the Israeli supreme court for a stay of execution.

?The injunction freezes any eviction for six days from the setting up of the camp on Friday,? activist Irene Nasser told AFP.

But ?the Israeli... administration in the West Bank considers that this injunction applies only to the tents, not the people. This is why they tried to make us leave this morning?, she added.

The protest outpost, named Bab Al Shams (Gate of the Sun in Arabic), lies between occupied Arab East Jerusalem and the Jewish settlement of Maale Adumim.

An AFP journalist said that protesters on the freezing hilltop were in good spirits as they sought to heat tea and coffee, waving Palestinian flags and chanting ?Palestine is free!? and ?Down with the occupation!?

?It?s nice to build a village here without Israeli permission. We are here to stay,? an activist from Ramallah told AFP, speaking on condition of anonymity.

A hundred Palestinians, with blankets, food and water arrived in the early afternoon by bus from Ramallah, an AFP journalist said.

Other activists from Ramallah and Hebron were set to join later, activists tweeted.

?We Palestinians are still pessimistic but this initiative gives us reason to be optimistic,? Omar Ghassan, 27, from Ramallah told AFP. ?This is a new type of resistance, different to armed resistance or stone-throwing,? he said, adding that he had spent the day in the camp.

The international community regards all Jewish settlements on occupied Palestinian land as illegal. The Israeli government makes a distinction between those which it has authorised and those it has not, and sometimes clears the latter.

Notre Dame football: Kelly raises plenty of questions

SOUTH BEND -- Since he arrived at Notre Dame, consistency has been one of the fundamental principles on which Brian Kelly has built the Irish football program.

His recent flirtation with the NFL puts him perilously close to the "do as I say, not as I do" cliff. In both message and method, Kelly's moment with the pros is lacking.

The next time he demands consistency in approach from his team, how will it be perceived?

On one hand, he knew he was going to be hit with the NFL question early in his one-hour BCS National Championship Game media day grilling last Saturday. He was able to stay coy and ambiguous enough, until he said leaving Notre Dame "is not an option."

That answer came on what was probably the third wave of reporters who came past Kelly's perch, about 45 minutes into the session. He wasn't as definitive on earlier inquiries.

Of course, coaches are trained to think and act in the here and now. At that time, on stage in the heat and humidity of Sun Life Stadium, it likely wasn't an option. A few days later, even before the dents of the 'Bama cleat marks all over the Irish had gone away, it obviously became a consideration.

On the other hand, of all the self-righteous schlubs sardined around Kelly for that hour, who wouldn't listen to a lucrative, high-profile opportunity from a major media outlet? Rest assured, the media likes more money just like coaches do.

Hard to cast blame.

That won't stop Notre Dame fans from tossing stones, assailing his loyalty and questioning why the $2.5 million base salary isn't enough.

It won't stop rival coaches from whispering those doubts into the ears of recruits.

It's not like Kelly is the first college coach to be wined and dined by the NFL. Heck, Oregon's Chip Kelly has danced that dance each of the last two postseasons.

"The fans have been all over the map," said Aaron Fentress, Oregon football beat writer for The Oregonian. "Some are asking questions. Some get it. They know the next time the team is .500, the coach could be gone."

After last year's fling with Tampa Bay, which ended in a mutual split, it took some work on the recruiting trail.

"When (Chip Kelly) went back to recruiting, he told the kids, 'We're (OK). Whenever you're good, you're going to get attention, and I'm going to listen,'" Fentress said. "He didn't promise he was going to be around for five or 10 years."

Oregon's 12-1 season, in which the Ducks finished No. 2 behind Alabama, didn't seem to be negatively impacted by the NFL's interest in Chip Kelly.

The recruits understood. College football isn't the game it used to be.

If Brian Kelly does leave for the NFL, he would be the first Notre Dame coach in the modern era to downgrade the job from destination to stepping stone.

Coaches don't get tenure; most are transients, loyal to the logo they happen to be wearing. It's a high-risk, high-reward profession. Another 8-5 this year and Notre Dame might have launched Brian Kelly. He understood the possibility existed. At 12-0 before the Alabama disaster, he's everyone's coach of the year.

Strike while the iron's hot.

David Pogue hittin the crack pipe. And the Microsoft Surface.

The PC market is contracting. Full stop.?

The PC market is becoming marginalized -- my long-held view from day one of this site. And, to be honest, my view was based entirely on the smartphone. When I started writing about the smartphone wars 4 years ago I did not expect that Apple -- Apple! -- would be selling a kick-ass computer for $350!

The one ring to rule us all -- Windows -- is becoming less and less relevant to our lives.?

Not that this means Windows is dead. There remains a massive PC install base. There are a billion smartphones in use, and that number will soon grow to at least 2 billion and, I suspect, more than 50% of each of those will be disposed for a shiny new smartphone every 15 months or less.

Anyone tells you the smartphone market is saturated does not know what they are talking about.

And as Frank X Shaw, Microsoft's communications shinobi and Twitter badoy will tell you, this game is not over.?

But, damn, Microsoft is late to this party, very late, and seems as if everyone's already hooked up with someone else.?

For me, the rage, the bitterness, the pent-up fury that rose like bile during the years of the Microsoft Terror are mostly gone. They are a big, smart, capable American company. I want them to do well. Honestly. I want America -- Apple, Google, Twitter, Facebook, Microsoft, Amazon -- to rule the planetary smartphone wars.?

Microsoft's strategy for global domination, or in this case, relevance, is a sharp new OS that combines touch and type working across PC, tablet and smartphone. Which I absolutely believe is the best strategy.

In 2020 when shit can all work together like that.

Right now, and this is true for Apple and Google and, as is now painfully obvious given Windows 8 reviews, true for Microsoft, our very best people can't make all this work together seamlessly, intuitively. This harsh reality notwithstanding, Microsoft's current strategy of the same OS across all devices is the wagon they've hitched their sizable cart to.?

Only, their long-time partners don't seem to agree. Or won't or can't get on board with this.

Forcing Microsoft to bulid its own PCs -- or in this case, Surface Pro tablet.

On paper, the Microsoft Surface Pro could be killer. It's a laptop! It's a tablet! It's got Windows! It does all the Office and Windows-compatible stuff you require. And apps!

At least, that is, if you purchase the Microsoft Surface Pro with Keyboard but not with RT edition.?How is it truly??

We don't know. Despite Apple having already sold over 100 million tablets, this Surface is not available. Still. But...New York Times gadget reviewer, David Pogue, got a "hands on". Kinda. He got to play with one a bit while at CES.

Pogue's verdict after spending a few minutes with the device while under the watchful eyes of Microsoft reps??

FUCKING AWESOME!

But you?re looking at an entirely new kind of machine, one with new possibilities. It?s a touch-screen tablet, of iPaddish proportions, that runs desktop software: Photoshop, Quicken, the full Microsoft Office, iTunes (and Apple?s online movie and music stores). Desktop software on a half-inch-thick tablet. That?s a first.

?

Microsoft has pulled out all the stops to make sure that you?re not disappointed in either of the two functions, tablet or PC. The screen is dazzling: bright, crisp and responsive. It has 1,080 by 1,920 pixels, also known as 1080p high definition. But when you connect it to a TV or external computer monitor, it manages to output an even bigger desktop ? 2,550 by 1,440.

?

That you can use it at home as your main PC is only the first indication that Microsoft intends for this tablet to go head-to-head with actual computers. Another is the speed: it?s fast.

What really makes the tablet/PC concept sing, of course, is the famous Surface keyboard cover.?

I remain more skeptical than hopeful.?

This is Microsoft's first real foray into "PC" hardware. It's 2 pounds. It costs about the same as the low-end MacBook Air. Or, an iPad (new) plus an iPad Mini, with cash left over for iWorks and all those Angry Birds games.

If Pogue is right, than Microsoft may -- may -- have a winner on its hands. Assuming they can build the thing in sufficient numbers, sell it in sufficient numbers and support it in sufficient numbers.?

Frank X Shaw suggests we are at the end of the first quarter of play. Perhaps. I think 2013 is more like the fourth quarter, and Microsoft is down. Windows 8, Windows Phone and Surface all need to prove themselves this year. If not, then I don't know if any favorable product review can rescue them.

AIG opts out of bailout lawsuit amid public vitriol

9 hrs.

The board of AIG decided on Wednesday not to join a lawsuit against the U.S. government over the terms of the company's bailout, following two days of fevered backlash from Congress and the public over the prospect.

AIG had been weighing whether to join a lawsuit filed by its former chief executive, Hank Greenberg, and his company Starr International, which owned 12 percent of the insurer before its 2008 rescue.

Greenberg alleges the rescue was unfair to shareholders, and that the Federal Reserve Bank of New York charged an excessive interest rate on its initial loan. He has sought billions of dollars in damages.

AIG said the board carried out its legal and fiduciary duty to consider the possibility of joining Greenberg's suits before making its decision.

"America invested in 62,000 AIG employees, and we kept our promise to rebuild this great company, repay every dollar America invested in us, and deliver a profit to those who put their trust in us," Chairman Steve Miller said in a statement.

AIG said it would not pursue Starr's claims nor would it allow Starr to pursue them on AIG's behalf, which sets the stage for a fresh legal fight between Greenberg and the company.

The idea AIG might sue the government struck a raw nerve with the public, which took to the Internet to vent its anger at what it viewed as the company's audacity. The volume of AIG mentions on Twitter rose more than 50-fold Tuesday, according to Topsy Analytics.

Former Obama administration adviser Austan Goolsbee said "GO SCREW YOURSELVES" in a multi-tweet tirade. Comedian Andy Borowitz drafted a mock letter from the company to taxpayers, asking for more bailout money to pay for the cost of the lawsuit. Dozens of obscene comments made descriptive references to the anatomy of Chief Executive Robert Benmosche.

And those were the gentler barbs. The New York Daily News ran an editorial cartoon in which a lifeguard saves a drowning man with "AIG" on his belly. When the lifeguard asks the man how he feels, the victim says, "like suing you."

The vitriol was just like in late 2008 and early 2009, shortly after the bailout, when AIG employees hid ID badges and their families were threatened amid an uproar over post-rescue bonuses.

A group of congressmen led by Vermont Democrat Peter Welch sent AIG's chairman a letter late Tuesday, advising, "Don't do it. Don't even think about it." Other members of Congress threatened hearings.

AIG took to Twitter to defend itself, saying it was legally obligated to at least consider action. But its defense mostly fell on deaf ears.

The government rescued the company from the brink of bankruptcy in September 2008 with a bailout that ultimately topped $182 billion. After a recapitalization deal closed in early 2011, the U.S. Treasury owned 92 percent of AIG.

Treasury sold the last of that stake in mid-December. All totaled, the government has said it earned a return of $22.7 billion on the rescue.

AIG shares were flat at $35.65. The stock lost half its value in 2011 but then rose more than 50 percent in 2012, as it showed consistent profitability.?AIG is considering Wednesday whether the company should join a lawsuit against the government that spent $182 billion to save it from collapse.?

A leading congressional Democrat called criticism of the deal's terms "utterly ridiculous," and former New York Attorney General Eliot Spitzer - who probed AIG when he was in office - called the prospect of a lawsuit "insulting to the public."?

The White House declined to comment on the potential for a lawsuit but defended the $182 billion bailout.?

Newly elected Senator Elizabeth Warren, feared by Wall Street as a potential thorn in its side on the Senate Banking Committee, called the lawsuit talk "outrageous" and said the company should not "bite the hand that fed them for helping them out in a crisis."??

Elijah Cummings, the ranking Democrat on the House Committee on Oversight and Government Reform, acknowledged that AIG's board has a fiduciary duty to consider the lawsuit. But he also said the company had a choice in 2008 and picked what it considered the better option.?

"The idea that AIG might sue the government is an unbelievable insult to our nation's taxpayers, who cleaned up the mess this firm created," he said in a statement.?

Cummings' former colleague, the recently retired Barney Frank, said he was "stunned" by the news and added that AIG was a fully willing participant in the rescue.?

"There was not the hint of a suggestion of any coercion. They did this very voluntarily, very gratefully. And if the company were now to go around and join this lawsuit, that would be outrageous," Frank said in an interview.?

daddacool: #Sharkstoppers campaign against the payday loan ...

This link is near the bottom of the press release which is below (doh!)

Stella Creasey, Labour MP for Walthamstow, is a leading supporter of the Sharkstoppers campaign against the payday loan industry. The new Financial Conduct Authority will have ?ability to cap the costs of credit, but not until April 2014.

In this article she argues that, in the meantime, much more needs to be done by the OFT to limit the damage and misery caused by these companies and asks for your help.

"In 2013 average household energy bills are expected to reach an all-time high of ?1300. A third of us are experiencing a second successive freeze in wages and the cost of food and travel continues to rise.

Little wonder it was reported four million of us intended to take out a payday loan just to cover the cost of Christmas.

Across the country companies offering loans with interest rates of 4,000% or more are now operating in every community, lending on every high street and online.

With one in three of these loans being used to pay off another payday loan, all too often this form of credit creates a spiral of debt.

Many end up borrowing more to pay off their original debt and still can?t make ends meet.

Research shows half of all borrowers who have taken out a payday loan have taken out credit that it turned out they just couldn?t repay and 57% have missed a payment, so incurring further charges they can?t afford.

Despite the problems they cause, surveys show five million Britons expect to have to use such credit to cover their everyday living costs in 2014.

With further cuts due to tax credits, the numbers relying on this toxic form of finance could rise beyond this peak; research shows ten million Britons feel financially precarious.

For two years Sharkstoppers campaigners have been calling for the Government to learn from other countries. Most nations have tackled the problems these firms cause by capping the costs of credit, so limiting the debts that consumers can get into when borrowing in this way.

Yet until recently the British Government resisted taking action, instead relying on these companies themselves to stick to their own voluntary codes of conduct. A recent report by the Office of Fair Trading delivered a damning indictment of this, showing how badly these firms treat British consumers.

The National Audit Office?s own work showed the failure to address the problems credit market cost UK consumers ?450m last year.

Thanks to the Sharkstoppers campaign the Government has finally agreed to give the new Financial Conduct Authority the power to limit the prices consumer credit companies can charge. However, this power won?t come into force until 2014.

Without action now, and with the rising costs households will face, 2013 could be a window of opportunity for these so called legal loan sharks.

To prevent this Sharkstoppers is now calling on the OFT to strengthen the ?irresponsible lending guidance' for these firms in 2013.

The guidelines the OFT brings in can set the standards for the new FCA and send the industry a clear message about what they can do in the UK.

Sharkstoppers wants this code to cover a number of issues, starting with setting out what it considers an irresponsible price of credit and so the cap that there should be on its cost.

The problems with this lending are not only caused by the high costs associated with it.

Some borrowers can end up taking out multiple loans, and many lenders make a virtue of the speed and limits of their credit checks. To make lenders responsible for the amount they offer and the consequences of borrowing, the OFT should require all lenders to report all loans made to a real time credit register at the very moment they provide the loan.

So too, the OFT should demand a reform in the way lenders use continuous payment authorities (CPAs) to address the concerns about fraud and debt this form of payment has created.

You can find out how you can help this campaign, along with a sample letter to send to your MP about the role of the OFT at: www.workingforwalthamstow.org.uk.

The success of Sharkstoppers so far shows we can make a difference against this well funded industry when we work together, as reports and research continue to show these companies targeting vulnerable consumers in Britain.

We must be vigilant in keeping up the fight to end legal loan sharking in 2013."

Boeing?s 787 faces scrutiny after latest mishap

3 hrs.

Boeing?s 787 Dreamliner is facing fresh scrutiny after a fire broke out on one of the new?model passenger planes while it was parked at a gate at Boston?s Logan International Airport.

It?s the latest of several problems that have been reported with 787s in the past couple of months, and the troubles come after yearslong delays during the airplane?s lengthy development process.

Still, aviation experts say it?s too early to say that the reported problems are a sign of serious issues, rather than just the growing pains associated with rolling out a new airplane chock full of fresh technologies.

?You?re always going to have glitches with a new airplane. One would prefer they not be fires,? said Mike Boyd, chairman of Boyd Group International, a consulting firm in Evergreen, Colo. ?But another thing to remember is there?s a lot of scrutiny on this airplane (and) a lot of focus on this airplane, so if a door latch doesn?t work we?re going to hear about it.?

The new 787 is groundbreaking in many respects, from its extensive use of composite materials instead of aluminum to its much heavier reliance on electronics. Aviation analysts said that by incorporating so many new innovations, Boeing also has left itself vulnerable to many more potential problems.

?There are a lot more glitches than normal, but there are a lot more new technologies than normal,? said Richard Aboulafia, vice president of analysis with Teal Group. ?They?ve tried an awful lot of new ideas with this plane.?

Scott Hamilton, an aviation industry consultant with Leeham and Co., noted that airplane makers have dealt with unexpected issues on new model airplanes going all the back to the propeller era. He said the big question is whether the fire Monday and the other issues that have been reported are ?isolated nuisances or more serious flaws. That?s something that even investigators may not have yet determined.

?What might be a real concern here is whether or not these are systemic, linked issues,? Hamilton said.

Federal investigators said they were looking into the cause of the fire Monday, which was discovered after all the passengers had deplaned.

Boeing spokeswoman Lori Gunter said in an email Monday that the airplane maker was aware of the event and was looking into it, but that no one would be available to comment further.

The fire follows several other issues airlines have reported with the 787.

In December, A United Airlines 787 had to make an emergency landing because of concerns about an electrical panel issue. Later that month, United said it had discovered the same issue with a second airplane.

United also said it would delay using a 787 on its flight from Houston to Lagos, Nigeria, while it continues to work with Boeing on reliability issues. But the airline is operating a 787 on a daily flight from Los Angeles to Tokyo.

Qatar Airlines also said in December that it had grounded one of its 787s?because of electrical issues, according to Reuters.

Separately, the Federal Aviation Administration also said in December that it had issued an airworthiness directive requiring airlines to check some new 787s for potential problems after reports of fuel leaks.

One of Boeing?s test 787s also experienced a fire during testing in 2010, before the airplane went into service. The airplane maker later traced the cause of the fire to a power panel.

The more recent problems follow a long and difficult development process for the 787.

Boeing delivered its first 787 to All Nippon Airways in the fall of 2011, more than three years after it had initially pledged to get the plane to its Japanese customer. The delays came after the company decided to outsource many major design and manufacturing elements to other companies around the world, in some cases resulting in costly delays.

Furthermore,?Boeing got into a spat with the National Labor Relations Board over its decision to assemble some of the 787 jetliners at a new, non-union facility in South Carolina. The aircraft also is assembled at a unionized facility in Everett, Wash. The charge was withdrawn after Boeing and its union came to a new collective bargaining agreement.?

Analysts noted that Boeing?s major rival, Airbus, faced similar issues with its gigantic A380 rolled out several years ago and also faced some initial problems.

?Any time you have a brand new product, particularly if it?s groundbreaking technology, you?re going to have heightened scrutiny,? Hamilton said.

Aboulafia said that in the long run he expects many of the technologies developed for the new 787 will pay off.

?So far there have been no absolute showstoppers - just a bunch of headaches - and eventually it will be vindicated as a very good new plane,? he said.

LG kicks of CES with 55-inch 'ultra-HD' TV

LAS VEGAS (AP) ? LG unveiled a 55-inch TV that sports "ultrahigh-definition" resolution with more than 8 million pixels, kicking off what is likely to be a mini-obsession with the latest super-clear format at the annual International CES gadget show.

The model announced Monday is the smallest in a 2013 lineup that includes 65-inch and 84-inch versions. But the smaller size ? and likely smaller price tag ? begins the parade of TV makers that are seeking to bring ultrahigh definition to the masses.

Also known as "4K," ultrahigh-definition screens are 3,840 pixels wide and 2,160 pixels tall and have four times as many pixels as the current HD screens.

For a few years, there won't likely be a mainstream standard for getting native ultra-HD movies and TV shows to the screen either by disc or broadcast.

LG said these new TVs will have upscaling technology that takes images of lesser quality and renders them in high detail. The Korean electronics maker also said it has formed an ultra-HD content agreement with Korea's top broadcaster, KBS, and is seeking out deals with other global content providers. The company offered no specifics.

Along with the lineup of higher-resolution TVs, LG unveiled a new Magic Remote, which acts like a wand that is sensitive to motion and is used to navigate on-screen menus. LG said the new model responds better to natural speech.

Sloan's Ice Cream Selects BoeFly To Assist Its Franchisees In ...

Sloan?s Ice Cream to offer BoeFly?s Concierge Team Services to its franchisees nationwide

Sloan Kamenstein founded Sloan?s Ice Cream in 1999 in West Palm Beach, Fla. Since then, Sloan?s Ice Cream shops have become destination favorites for South Florida residents and visitors alike. Plush toys line the walls, Sloan?s homemade sweets fill the countertops, and rich original ice cream flavors are served, made from the finest ingredients. Now, Sloan and his leadership team are launching an aggressive franchise growth strategy targeting Florida, California, the Carolinas, Georgia, New York and New England, along with additional areas nationwide. Sloan?s has already signed two franchising agreements, one with a franchisee in Southern California, another in South Florida. Company projections call for the first franchised Sloan?s Ice Cream shops to be near completion in early 2013, with additional openings throughout the year. Sloan?s anticipates a total of approximately 200 U.S. locations in the coming years.

?Everything about Sloan?s has been well thought out,? said David Wild, Sloan?s director of franchising, ?From our twinkling chandeliers and mouthwatering display cases, to the posh pink walls and ceilings, coming to Sloan?s is an escape from reality. With our planned expansion, we?re excited to offer BoeFly to support and position our franchisees to obtain financing.?

?Every franchisor faces significant challenges,??said Mike Rozman, co-president of BoeFly. ?Franchise lending has been down by as much as 40 percent in the past two years due in part to the inefficiencies in the lending process that have been exposed by the financial crisis. BoeFly eliminates these inefficiencies by connecting franchisees with banks that are ready and willing to lend.?

Phone makers scurry to get out 'phablets'

17 hrs.

SINGAPORE/HONG KONG????Call it phablet, phonelet, tweener or super smartphone, but the clunky mobile phone???closer in size to a tablet than the smartphone of a couple of years back???is here to stay.

A surprise hit of 2012, it is drawing in more users, more handset makers and is shaping the way we consume content.

"We expect 2013 to be the year of the phablet," said Neil Mawston, UK-based executive director of Strategy Analytics' global wireless practice.

While Samsung has blazed a trail with its once-mocked Galaxy Note devices, now other manufacturers are scurrying to catch up.

At this week's Consumer Electronics Show in Las Vegas, Chinese telecommunications giants ZTE and Huawei Technologies Co (HTC) will launch their own.

ZTE, which collaborated with Italy's designer Stefano Giovannoni for the Nubia phablet, is scheduled to launch its 5-inch Grand S, while Huawei brings out the Ascend Mate, sporting a whopping 6.1-inch screen, making it only slightly smaller than Amazon's Kindle Fire tablet.?

"Users have realised that a nearly 5-inch screen smartphone isn't such a cumbersome device," said Joshua Flood, senior analyst at ABI Research in Britain.

Driving the phablet's shift to the mainstream is a confluence of trends. Users prefer larger screens because they are consuming more visual content on mobile devices than before, and using them less for voice calls - the phablet's weak spot.

And as Wi-Fi-only tablets become more popular, so has interest among commuters in devices that combine the best of both, while on the move.

According to the latest Ericsson Mobility Report, the monthly data traffic for every smartphone will rise fourfold between now and 2018 to 1,900 megabytes.

The upshot is a market for phablets that will quadruple in value to $135 billion in three years, according to Barclays. Shipments of gadgets that are 5 inches or bigger in screen size will surge by nearly nine-fold to 228 million during the same period, though estimates vary because no one can agree on where smartphones stop and phablets start.

But that's the point, some say.

"I think phone size was a preconceived notion based on voice usage," said John Berns, a Singapore-based executive who works in the information technology industry. He recently upgraded his Note for the newer Note 2 and bought another for his girlfriend for Christmas. "Smaller was better until phones got smart, became visual."

Samsung has been both the engine and beneficiary. While other players shipped devices with larger screens earlier???Dell launched its Streak in 2010???it was only when the Korean behemoth launched the Galaxy Note in late 2011, with its 5.3-inch screen, that users took an interest.

"The Streak was launched at a time when 3-inch smartphones were standard and the leap to a 5-inch Streak was a jump too far for consumers," says Strategy Analytics' Mawston.

"The Galaxy Note was launched when 4-inch smartphones had become commonplace, and the leap to 5-inch was no longer such a chasm."?

The bigger, the better
Since then Samsung has bet big on bigger: its updated Note has a 5.5-inch screen and its flagship Galaxy S3???the best-selling smartphone in the third quarter of 2012 - has a screen that puts it in the phablet category for some analysts.

Samsung accounted for around three quarters of all phablets shipped last year, according to Barclays' Taipei-based analyst Dale Gai.

Samsung's marketing heft has paved the way for others. LG Electronics Inc accounted for 14 percent of shipments in the third quarter of last year, according to Strategy Analytics.

HTC Corp's 5-inch Butterfly???called the Droid DNA in the United States???has been selling well in places where Samsung is less dominant, according to Taipei-based Yuanta Securities analyst Dennis Chan. The first batch sold out soon after its December launch in Taiwan.

"I don't think we can say that Samsung invented phablets," said Lv Qianhao, head of handset strategy at ZTE. "But it did do a lot to promote this product category, which helped create tremendous demand."

Phablets are also proving popular in emerging markets.

A poll of nearly 5,000 readers of Yahoo's Indonesian website chose Samsung's Galaxy Note 2 as their favourite mobile phone of 2012, ahead of the iPhone 5.

Kristian Tjahjono, a technology journalist who posted the poll, said phablets were a natural fit for Indonesians who liked tablets but also liked making phone calls.

But while those in such markets who can afford them are going for the high-end devices, the door is opening for cheaper models. Tjahjono pointed to Lenovo's 5-inch S880, which has a lower resolution screen and sells for about $250, which is around a third of the price of Galaxy Note 2.?

Sweet spot
Falling component prices will add to demand. The total cost of an upper-end phablet, its bill of materials, will likely fall to 2,000 yuan ($323) this year, says Gai from Barclays, and will halve within two years.

"One thousand yuan is a very sweet spot for China," he said.

India is also a fan.

Vivek Deshpande, who manages global strategy for Shenzhen-based mobile phone maker Zopo, says that while the Indian and Chinese markets are different, they both share a common appetite for aspirational devices: phones big enough for their owners to show off. This is changing the direction of lower end players.

"Zopo's primary focus is now on phablets," said Deshpande.

Even Samsung is pushing its own creation downmarket: In Las Vegas it will unveil the Galaxy Grand, a 5-inch device that lacks some of the resolution and muscle of its bigger brethren but will be aimed at markets like India. There is a version offering a dual SIM slot, a popular feature for those wanting to arbitrage cheaper call and data plans.

As phablets slide into the mainstream, handset makers are trying to find ways of differentiating.

As well as hiring Italian designer Giovannoni better known for his minimalist, sleek bathrooms, ZTE also came up with an onscreen keypad that inclines to one side of the screen, depending on whether the user is left- or right-handed.

Samsung, however, not only has first mover advantage, it can also build on its expertise in display.

Barclay's Gai says Samsung is expected to introduce a thinner, unbreakable AMOLED screen which will leave room for bigger batteries.

"That will put Samsung in good stead to still dominate the market," he said. Despite pressure in China, Gai estimates Samsung's share of smartphones with 5-inch or larger screens to fall only from 73 percent in 2012 to 58 percent in 2016, which is still the lion's share.

By then consumers will see the phablet for what it is, says Horace Dediu, a Finnish analyst who runs a technology blog asymco.com. Its rise is part of a wider march of computing power into wherever we reside???the living room, the train, bed or work.

"It makes sense that we're moving towards a time where we are served not by a computer or a netbook or a phone, but rather that we have these screens scattered around and available for us to play with," he said. "In a way the phablet is not a bulky phone but a very delicate computer."?
